Scripps ACO and its participants must comply with certain federal laws and organizational policies. These policies, accessible below, help ensure our successful participation in the Medicare Shared Savings Program, while minimizing individual and organizational risk. 

Prohibition of Certain Required Referrals and Cost Shifting

Prohibition of Certain Required Referrals and Cost Shifting Policy (PDF, 440 KB) outlines prohibitions against certain Scripps ACO provider referral activities and patterns, including:


  • Federal health care business provided to beneficiaries not assigned to Scripps ACO
  • Referrals within the Scripps ACO provider network; and
  • At-risk beneficiaries

Accuracy of Data Submitted

The Accuracy of Data Submitted Policy (PDF, 360 KB) covers Scripps ACO’s obligation to completely and accurately submit all data and information required by CMS, including quality performance measures.

Prohibition of Certain Beneficiary Inducements

The Prohibition of Certain Beneficiary Inducements Policy (PDF, 330 KB) covers the prohibition of gifts and other remunerations to Scripps ACO beneficiaries, as well as allowable in-kind items or services.

Compliance with Program Requirements and Applicable Laws

The Compliance with Program Requirements and Applicable Laws Policy (PDF, 370 KB) states Scripps ACO’s duty to comply with all applicable laws, including the Anti-Kickback Statute, the Physician Self-Referral Law and antitrust laws. It also outlines permissible waivers to certain federal laws, which are granted to ACOs by CMS.

Maintenance of Provider Enrollment Data

The Maintenance of Provider Enrollment Data Policy (PDF, 430 KB) covers Scripps ACO participants’ obligations for updating their Medicare enrollment information. This includes prompt and accurate use of Medicare’s PECOS enrollment system, and timely notification to Scripps ACO.

MSSP Marketing

The MSSP Marketing Policy (PDF, 440 KB) outlines Scripps ACO’s duty to comply with all marketing requirements (PDF, 390 KB) set forth by CMS.

Point of Care Notifications

CMS requires Scripps ACO participants and SNF affiliates to notify beneficiaries at the point of care that their provider is part of the Medicare Shared Savings Program.

Acceptance of Governmental Agency Access to Scripps Community Connect

Certified Electronic Health Record Technology (CEHRT)

Starting in 2025, the use of certified electronic health record technology (CEHRT) is a requirement for all MSSP participants. Please read the CEHRT policy (PDF, 100 KB) for additional details.
